Job Description and Qualifications

We are currently looking for a Senior Subcontracts Manager to join our team-based for a project in Immingham, UK (initially based on the head office in Hersham, UK), but will be based at the site location for project execution. You’ll be reporting to the Regional Subcontracts Manager EMEA. This position requires extensive experience in - contract strategy development and creating workable contracting plans for execution,

  • Drafting market enquiries using pro-forma contract models for a wide range of major contracts including full EPC scope delivery.
  • Deep understanding of contracts commercial models application (Unit rates, reimbursable and Lump Sum) and the contract administration for managing and understanding of contract terms (including tailored models) for contractual intent and application
  • Negotiation and award of contracts to ensure alignment on technical and commercial evaluation for execution of contracts.
  • Quantity Surveying understanding for the application of remeasure contracts and monthly payment approvals against progress, and evaluation of progress payments for reimbursable and Lump Sum services.
  • Thorough experience in Change Management and documenting contractual arguments/commercial recovery for defence in prolongation, progress delays, resourcing issues which impact project delivery.
  • Claims management including documenting counter claims, defending claims and communicating defence to protect project results against cost and schedule.
Key tasks and responsibilities – what you’ll be doing

  • Work with Project teams (engineering, construction, commissioning, project controls, commercial etc), supporting the Project to achieve goals primarily focused on Contracting Strategy, Proposals, Sourcing, Contracting Awards and Project Contract Execution for Engineering, Construction and EPC Projects. This includes:
  • Proposal and estimating support for Projects including sourcing budget pricing from the market as a requirement for benchmarking market rates and resource availability.
  • Preparing and implementing the Projects Subcontracts Strategy identifying the life of project requirements including working with planning and cost/estimating to understand budget allocations against contracts.
  • Prepare and implement the sourcing plan identifying and qualifying suppliers including EPC companies, engineering & construction suppliers to meet Air Products requirements and understand safety, commercial, technical and capacity risks.
  • Drafting and preparation of bidding documents and the Pro-forma Contract including technical scope of work, pricing schedules for various commercial models including remeasure contracts, QA/QC and HSSE requirements, and contract execution requirements.
  • Leading bid packages including issue to the market, clarifications, technical and commercial evaluations, negotiation and placement of contracts.
  • Conducting Kick-Off meetings and leading Subcontract and commercial meetings internally and with Suppliers. Leading the Contracts team meetings (in alignment with Procurement for free issue equipment delivery dates) to manage the contract demand planning and raising any potential or actual problems, delays or commercial impacts which could adversely affect delivery of the contractual programme.
  • Responsible for the timely preparation of legal and contractual documents such as Letters of Instructions, Contract Change Orders / Modifications, Insurance Documents, Subcontractor Approval packages, Certificate of Final Acceptance, and other legal or contractual requirements as needed.
  • Leading the preparation of and negotiating cost impacts and schedule changes with Suppliers for contract Change Orders / modifications / claims assessment / arbitration.
  • Performance management of contracts. Manage relationships with suppliers and maintain interface at senior level within their organizations.
  • Critical competencies
  • EPC Contract management is critical for this role and understanding of end-to-end contract placement to close out and knowledge of both tailored contract models and FIDIC Red, White and other models including NEC applied for Project Execution.
  • Core skills in contract management, administration and claims resolution; including experience in quantity surveying to apply both lump sum and remeasure contracts for construction.
  • Strengths in drafting contracts and legal understanding of contract risk and the key clauses for contract execution and successful delivery of projects
  • Integrates cost forecasting and planning for subcontracts management throughout the project lifecycle.
  • Excellent negotiation and contract resolution skills.
  • Strong influencing, communication, and facilitative skills, including cross cultures and geographies,
  • Demonstrated ability to effectively communicate (written and verbal) technical and non-technical information, internally and externally.
  • Strong organizational and time management skills
  • Good analytical and problem-solving skills
  • Strong understanding of macro-economic factors
  • Ability to support forecast cost modelling, and contract commercial applications.
  • Desire to work in a fast-paced environment.
  • Excellent knowledge and proficiency with the Microsoft office suite (Excel, Word, PowerPoint, One Note) and collaborative tools.
  • Good Knowledge of SAP and requisition to pay processes.
What we’re looking for;
  • MRICS and or CIPS
  • Bachelor of Engineering (preferably Mechanical / Civil) or QS degree is advantageous.
  • Master of Business Administration is advantageous.
  • Extensive experience working in an EPC / Oil and Gas company including FIDC / QS experience and understanding.
  • Experience in contracts and contractual language.
  • Excellent oral and written English proficiency is a must. Second language is advantageous.
