Job description

My client is one of the leading providers in insurance and legal services with multiple offices across the UK and they are looking to recruit a Intermediate Track File Handler to join the expanding team.

The ideal candidate will be responsible for all aspects of litigated and non-litigated personal injury claims to include minor brain injury cases. The cases will be a mix of Portal, Fixed and some limited OIC cases that are dealt with by the Intermediate Track Team. The cases will mainly involve RTA, some MIB and some EL/OP/PL claims.

Key Duties & Responsibilities

  • Running a case load of personal injury cases with a value of less than £100,000 efficiently, proactively and profitably.
  • Dealing with Fixed Fee and Portal RTA including untracted and uninsured MIB claims with the intention of maximising damages for the customer by pursuing all relevant heads of loss.
  • Ensure appropriate medical and non-medical evidence is obtained in accordance with the relevant track and recoverability.
  • Attend conferences, hearings and CMC’s with Counsel if necessary.
  • Advise customers as to litigation/cost risks where appropriate and the risks associated with fundemental dishonesty.
  • Ensure appropriate instructions are obtained from any relevant lay and/or insurance customers, litigation friend, attorney or deputy.
  • Prioritise urgent schedule entries and and deal with remainder of daily tasks on To Do List as well as Court Direction ensuring all are completed in a timely manner.
  • Achieve various targets set in relation to fee income, issuing, settlements, closures and securing positive customer reviews.
  • Ensure customers are kept informed and up to date throughout the life of the claim utilising technology where appropriate but maintaining a personal connection with the customer throughout.
  • Build constructive and positive working relationships with Defendant Solicitors and Insurers with a focus on collaborative working where appropriate.
  • Continually risk assess from the outset and duration of the case to ensure that the prospects of success are sufficient to justify continuance and to extract from cases where prospects of success fall below 51%.
  • Ensure that any relevant insurer is kept updated and fully informed as to the progress of any claims to reduce any potential exposure/liability and to increase savings.
  • Ensure that correct retainers and rates are sent to the customer and that costs estimates are updated annually and retainer rates reviewed regularly.
  • Ensure that the correct medical and other evidence is obtained in order that the claim can be advanced and/or maximised.
  • Discuss liability and/or quantum offers with the relevant parties, making use of the telephone rather than letters whenever possible.

Experience & Knowledge:

  • An experienced File Handler with significant experience of running their own claimant case load of personal injury claims within the RTA Portal and the former Multi Track (now Intermediate Track).
  • Experience of working to a fee target and/or litigated cases and/or settlement targets.
  • A good working knowledge of the law relating to credit hire.
  • Ability to handle a litigated case load.
  • A willingness to be involved in the mentoring and development of colleagues.
  • Have a good working knowledge of the CPR and/or other relevant case law and/or legislation and be able to progress claims in a timely manner in accordance with the CPR.
  • Be able to provide written and oral advice in a clear concise manner.
  • The ability to liaise and build up a rapport by using effective communication with all external agencies during the life of a claim including medical agencies, investigators, barristers etc.
  • Good IT skills with a sound working knowledge of VF or a similar case management system and essential MS Office knowledge.
  • Excellent time management and organisational skills, with a calm and methodical approach to work, and a flexible and adaptable attitude to resolving issues.
