Job description

We are looking for a keen, experienced clinician with a health or social care qualification and a good understanding of Deprivation of Liberty Safeguards, to join our small team, to take our Dol's assessments from discussion to to court decision, and support other team functions as a Clinical Quality Assurance Manager
The post holder will be part of the s117 Aftercare and Specialist Placement Quality Leadership Team and will bring relevant knowledge, skills and experience to the team supporting the delivery of assurance regarding safe, effective, quality services.
You should have knowledge and experience of direct working with people experiencing Mental Health, Learning Difficulties and / or autism .
The post holder will work within the team to complete outstanding and upcoming Community Deprivation of Liberty Safeguards (DoLS) Applications or Judicial Dols applications, ensuring applications are completed as required within a legislative framework.
  • This will be an operational role undertaking Dols applications with a primary responsibility for the oversight of the DoL’s caseload and associated reviews as well as other tasks relating to the team.
  • Undertaking the steps required to enable the progress and completion of community and Judicial DoLs assessments, completion of thorough mental capacity assessments and applications to the Court of Protection, including document submission.
  • Providing professional expertise, support and advice to practitioners, multi-agency partners, and to individuals and their families.
  • Ensuring the delivery of a high quality, comprehensive DoLs assessment and review for all people identified as s117 eligible who lack mental capacity and meet the ‘acid test’ on behalf of BSOL MHPC
  • Ensure that the team deliver completed MCA, BI decisions, and applications for Community DoL or Judicial DoL for those open for funding.
  • Support the Senior Clinical Quality Assurance Manager and Deputy Lead Nurse MHLDA on the prioritisation of applications and identifying risk situations.
  • Support practitioners by identifying recommendations to reduce restrictions and maximise choice and control.
  • Provide liaison between social care and provider services, to ensure least restrictive practices and / or safeguards are in place.

  • The post holder will assist in the ongoing development of an effective and high-quality service in compliance with the Mental Capacity Act (Amendment) 2019 and in line with emerging case law.
  • The post holder will be familiar with working in diverse situations which require specialist experience, expertise and sensitivity, working with a caseload primarily consisting of those eligible for s117 aftercare.
  • Ensure that the team delivers support to patients and their families/network to better understand what constitutes a deprivation of liberty and the safeguards that exist to protect their rights including their right to make an application to the Court of Protection.
  • The post holder will link in with ICB legal and DoLS leads as well as being involved in future developments.
  • Provide leadership to the team regarding working in partnership with patients and carers to enable them to make informed choices about care and support and inform family members/friends pertaining the role of Rule 1.2 representative. Provide guidance on completing consultation with the person as part of the application and the COP24 witness statement.
  • Being responsible for supporting team in liaising with the ICB legal representatives to make applications to the Court of Protection for a hearing in cases where there are objections, disputes or specific welfare issues that need to be decided in the client’s best interests by a court judge.
  • Complete court work and attend hearings both virtual and in person as part of ongoing proceedings
  • Lead, attend and contribute to meetings and forums in relation to Community and Judicial Deprivation of Liberty, MCA, BI as required.
  • Develop good practice in compliance with the MCA 2005 and 2019 amendment, promoting the legislation, deprivation of liberty process and providing advice and support, in line with changes in legislation.
  • Identify, report, and appropriately respond to Safeguarding alerts/concerns. To understand and utilise the escalation policy when safeguarding outcomes are not met.
  • To ensure the service is delivered with the person at the heart of the assessment process and that the pathway is completed in line with best practice.
  • Identify and disseminate areas of good practice through appropriate networks considering the impact on the wider organisation, as required
  • Be responsible for developing policies and procedures in own work function process and that the pathway is completed in line with best practice.
  • Proactively raise issues and provide solutions in partnership with other colleagues in relation to change management, working across agencies to enhance seamless care.
  • To provide specialist support and responsibility for developing future strategies for ongoing multidisciplinary training / support for practitioners as needed
  • Participate in the support of enquiries by the general public, this includes complaints, subject access requests and Freedom of Information requests
  • To have good knowledge of effective and efficient approaches to treatment, challenging accepted practice, and propose alternatives where appropriate.
  • Update, maintain, organise, gather and analyse information to predict/meet future organisational and team needs by identifying best professional practice.
  • Deliver against objectives, achieving quality outcomes, prioritising own workload, and working to tight deadlines.
  • Be responsible for leading team meetings.
  • Promote equality and value diversity in line with trust policy.
  • Maintain professional registration and ensure that the key principles of the registration are adhered to.
  • Be responsible for reporting progress, challenges, and key issues to Senior Leaders across the MHPC.
  • Participate in short, medium and longer-term business plans, achieving quality outcomes.
  • Responsible for proposing and drafting changes, implementation and interpretation to policies, guidelines, and service level agreements within the service.
  • Works with key partners to develop joint policies and procedures which will enhance the overall delivery of service-to-service users and enable closer working practices
  • Drafting reports summarising status on issues, appraising outcomes, and providing progress reports for Senior Colleagues.
  • Ensure that data collected is analysed, reported by the team as appropriate and monitor the processing of data and information, including forecasting and forward planning
  • Take responsibility for ensuring own clinical records are accurate, contemporaneous and maintained in accordance with the standards set out in relevant professional Guidance and MHPC/ BSMHFT Policy.
  • Keep up to date with changes in law, policies, processes and systems in relation to the post and share with relevant parties.
  • Provide Quality Assurance of MCA, DoL and LPS work across BSOL ICS.
  • To actively participate in S117 and specialist placement reviews for those individuals where a deprivation of liberty occurs or a Dol’s is in place.
  • To cover for colleagues and / or deputise for line managers as required
  • To provide support and guidance for management of complex individuals, who may have mental health, learning disability or Autism diagnosis
