Job description

Job Title: Part Time Legal Counsel
Location: Home based with some travel/office working according to business needs. Our main UK Home Care offices are in London and Epsom (with branch offices around England & Scotland)
Hours: Part time, 16-20 hours, flexible working days
Salary: GBP30,000 - GBP35,000 dependent on amount of hours worked (FTE salary cGBP65,000 - GBP70,000)
Role Purpose
Please note - this is a part time roleTo provide legal, GDPR, Freedom of Information advice and solutions to the UK Homecare brands (The Group)Advising on complex legal issues and regulatory requirementsManagement of disputes and litigationIdentifying and mitigating legal risksKeeping knowledge of legal developments up to date in and increasingly regulated, competitive and complex environmentThe job holder is an officer of the Court and required to conduct himself/herself in accordance with the Solicitors' Code of Conduct and applicable law and is subject to regulation by the Solicitors' Regulation AuthorityEnsure the business is compliant with data protection legislation

Legal Counsel
Providing effective and appropriate legal advice and assistance as required by the GroupReviewing, drafting and negotiating contractsSupporting a range of standard and bespoke procurement contracts and queriesAssisting the Group regarding the assessment and management of legal and commercial riskTraining the Group on legal and regulatory issuesHelping to ensure that business is conducted in accordance with relevant law and the Group's internal governance processesInstructing external lawyers and managing external legal fees under appropriate supervisionProviding preliminary advice on disputes and litigationAdvising on regulatory complianceHandle drafting of any and all resolutions and filings at Companies HouseEnsuring compliance with the Group's policies and processesActing within area of work and seeking guidance where appropriateData Protection
Ensuring that data protection policies, standards and guidelines are operating effectively and making changes to these when neededInvestigating and responding to Information Commissioners Office (ICO) complaints or queries.Responding to data protection queries and questions across the businessesServing as the Supervisory Authority local point of contact as needed in coordination with the Group DPOSharing questions/best practice with the Global Data Protection NetworkCompleting reporting requirements to be sent to the Group DPO as requestedAccountabilities
Legal Counsel
Identifying and mitigating legal riskTimely advice and assistance to the GroupTechnical accuracy and good judgmentManagement of disputes and litigationRelevant legal training to the GroupEffective management of external legal advisersClear communicationData Protection
Being an advocate of the Group's Privacy Programme across the businesses and support delivery of its objectivesIdentifying any gaps in compliance with the UK GDPR and other relevant local laws; make recommendations as to appropriate remediation/mitigation activities and undertake the implementation of those activitiesWorking with stakeholders to ensure that Data Processing Agreements with partners/suppliers is lawful and falls under appropriate protocols and codesDealing with data protection queries including data subject access requestsInvestigating and responding to data breaches, working with Senior Management to identify remedial actions and ensure they are implemented by given deadlinesProviding reports to Directors on progress with complianceConducting Data Protection Impact Assessments (DPIA)Analysing all complaints and following up to ensure all complaints have been resolved satisfactorilyDesign and carry out training programs to achieve compliancePerson Specification
Educated to degree level or equivalent with recognised legal UK qualification (Solicitor in the UK or equivalent jurisdiction)In-house legal experience in relevant industry desirableDemonstrated experience in reviewing, drafting and negotiating contracts for goods, services and technology/IST, practice of commercial lawExperienced in advising on legal and commercial optionsExcellent communication and interpersonal skillsExcellent technical contract drafting and negotiation skillsProblem solving - experienced in identifying and analysing key information to make balanced and appropriate decisionsAbility to manage relationships successfullyProven ability to balance and prioritise a large workload in a fast-paced environment
