Responsibilities
- Act as a key point of contact for the customer on commercial issues relating to the programme.
- Support development of robust Commercial processes and procedures appropriate for the programme in line with the company business management systems. Implement, and maintain such processes.
- Manage the Contract administration process ensuring H&W interests are protected, reducing risk exposure and maximising revenue / margin
- Manage contract changes and variations proposed and received to ensure these are effectively implemented and HW commercial risk is minimised; providing commercial input.
- Ensure systems, processes and documentation are available for audit.
- Provide advice on contractual liability and other commercial issues.
- Ensure all necessary commercial documentation and governance requirements are communicated and understood across the programme so it is aware of its commercial obligations.
- Work with the Procurement lead and sub-contract managers to flow down to supply chain appropriate obligations.
- Identify and mitigate commercial risks and provide commercial mitigation to broader programme risks.
- Recommend corrective action to non-compliance outlining procedure and strategy
- Conduct corrective action in line with legal and commercial procedure
- Support the Contract Review process which effectively communicates contractual obligations throughout company, service providers and supply chain
- Lead and contribute to key Customer engagements, negotiations, discussions and support any reporting processes as required within the contract
- Support the contract close-out process ensuring lessons learned and customer feedback is effectively captured, reviewed, and implemented / acted upon
- I influence and monitor Commercial activities cross the project and manage seamless interface across all internal and external stakeholders to drive best practice and continual improvement
- Manage functional input to wider bid activities and contract negotiations advising on technical/pricing risk and contract performance delivery.
- Maintain record of payments against milestones and negotiate milestone payment plans with a view to the cash flow position.
- Support the growth and development of an efficient and effective commercial management capability
- Play a strong role integrating the business across all Departments ensuring a “One Team” approach to delivery
- Identify collaborative opportunities which support competency development, growth potential and capability development
- Drive and coordinate the activities of a multi-faceted team within the wider business. Ensure technical support, input and decisions are integral to bid reviews, bid compliance, bid submission and lessons learned areas
- Achieve defined business objectives, SLAs and KPIs
- Proactively manage and communicate on opportunities, threats and risks for the commercial function
- Champion business’ culture, values, and reputation.
- Execute the responsibilities of this role as required by regulation and law.
- Follow internal policies, standard operating procedures, best practice, office conduct and external legislation.
- Pursue personal development of skills and competencies and participate in training and development. Actively promote same across the wider team.
Essential
- Degree in business, law or related discipline or evidence of equivalent experience.
- Good working knowledge of UK contract law.
- Experience negotiating and securing complex, medium to large scale contracts.
- Experience and understanding of contract structures and varying contract arrangements
- Sound knowledge and working experience of commercial and financial models
- Interest and awareness of current political, environmental, regulatory, and business issues.
Desirable
- Minimum of 10 years’ experience in a commercial role within defence or marine industries.
- Achieved World Commerce and Contracting or Member of Chartered Institute of Purchasing and Supply
- Proficiency in Spanish would be desirable but not essential.
- Knowledge of UK and EU import / export requirements.
- Experience working on UK MoD programmes.
